By “Opting In” to using the Bitcoin Help’s Text Message Service (SMS), you agree that you have read and understood, and, as a condition of your use of our SMS services, you agree to be bound by the following SMS Terms & Conditions (“SMS Terms”), including the Bitcoin Help Terms of Service containing arbitration provisions and the Company’s Privacy Policy.

ODT, Inc. through our service Bitcoin Help (“we,” “us” or “our”) may send you text (SMS) messages at the mobile phone number provided by you. Your use of the SMS Service constitutes your agreement to these SMS Terms & Conditions. We may modify or cancel the SMS Service or any of its features without notice. We may also modify these SMS Terms at any time and with your continued use of the SMS Service following the effective date of any such changes shall constitute your acceptance of such changes.

OPT-IN

To Opt-In to participate in Bitcoin Help’s Text Message (SMS Service) you will need to follow the instructions provided by Bitcoin Help representatives which may include texting a message to a shortcode, filling out a form, or otherwise signing up and providing your consent. You may be prompted to confirm your consent by replying “Y” (or other designated response) to an initial text message sent to you. When you opt-in to receive messages from Bitcoin Help, you provide express consent for us to contact you at the mobile phone number you provided when signing up or any other number that you designate.

We do not charge for the SMS Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless carrier. Message and data rates may apply.

Text (SMS) messages may be sent using an automatic telephone dialing system or other technology. Your consent to receive autodialed marketing text messages is not required as a condition of purchase or service availability. If you have Opted In, the SMS Service provides updates, alerts, information, promotions, and other offers from Bitcoin Help via text message through your wireless carrier to the mobile number you provided.

OPT-OUT

Message frequency is recurring. You may opt out of receiving marketing text messages at any time by sending an email to support@bitcoinhelp.tech indicating that you no longer wish to receive text messages or by replying “STOP” to Opt-Out at any time. You may continue to receive text messages for a brief period while we process your Opt-Out request, and you will also receive a one-time text message confirming receipt of your request to Opt-Out. For SMS Service support or assistance, reply “HELP” or email support@bitcoinhelp.tech.

We may change any short code or phone number we use to operate the SMS Service at any time. You acknowledge that any messages, including STOP or HELP requests you send to a shortcode or phone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

SERVICE AVAILABILITY – DUTY TO NOTIFY

Wireless carriers supported by the SMS Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile phone number. If you change your mobile phone number, you agree to Opt-Out of the SMS Service prior to changing your mobile number. You agree to indemnify, defend, and hold us harmless from any third-party claims, liability, damages, or costs arising from your use of the SMS Service or from you providing us with a phone number that is not your own. You acknowledge that network services, including mobile network services, are outside Bitcoin Help’s control and we are not responsible or liable for issues arising from the network services. If your mobile carrier does not participate, you will not receive a reply to your text messages. Some carriers may not support SMS services. Check with your carrier to confirm participation.

You agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the SMS Service, any errors in such information, and/or any action you may or may not take in reliance on the information of SMS Service.

You agree to indemnify, defend and hold Bitcoin Help and ODT, Inc. harmless from any claim or liability resulting from your failure to notify us of a change in the information you have provided, including any claim or liability under the Telephone Consumer Protection Act (47 U.S.C. § 227), or similar state and federal laws resulting from us attempting to contact you at the mobile phone number you provided.
